BY NOOLA Terms of Service

1. Terms

By viewing the website at http://www.bynoola.com.au, you are agreeing by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. By default, the materials contained in this website are protected by applicable copyright and trademark law unless stated otherwise.

2. Use License

  1. By viewing the site permission is granted to temporarily download one copy of the materials on BY NOOLA's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

    1. modify or copy the materials;

    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

    3. attempt to decompile or reverse engineer any software contained on BY NOOLA's website;

    4. remove any copyright or other proprietary notations from the materials; or

    5. transfer the materials to another person or "mirror" the materials on any other server.

  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by BY NOOLA at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

  1. The materials on BY NOOLA's website are provided on an 'as is' basis. BY NOOLA makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

  2. Further, BY NOOLA does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall BY NOOLA or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on BY NOOLA's website, even if BY NOOLA or a BY NOOLA authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Accuracy of materials

The materials appearing on BY NOOLA's website could include technical, typographical, or photographic errors. BY NOOLA does not warrant that any of the materials on its website are accurate, complete or current. BY NOOLA may make changes to the materials contained on its website at any time without notice. However BY NOOLA does not make any commitment to update the materials.

6. Links

BY NOOLA has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by BY NOOLA of the site. Use of any such linked website is at the user's own risk.

7. Placing your order

7.1 When placing your order with BY NOOLA please ensure you select the right quantity, page number and photo selection preference. If you have placed your order and realised there has been a mistake in the above, or if you have just changed your mind, please contact us at hell0@bynoola.com.au. If this is done prior to us starting the design process, we shall refund you or invoice you for the difference depending on your changed preference. Not until we start the design process with you and receive your photographs and wording has the order been fully accepted by us.

7.2 You must pay for the product in full at the time of ordering by supplying us with your credit or debit card details from a credit or debit card company acceptable, which we require in order to process and start your design. Alternatively, you may pay by any method that we have said is acceptable to us including Paypal and electronic funds transfer, but in any event we shall not be bound to supply before we have received cleared funds in full. Depending on the results of a credit check we reserve the right not to offer certain forms of payment and to refer you to our other forms of payment. If you are asked for details of a payment card, you must be fully entitled to use that card and its corresponding bank account. The card or account must have sufficient funds to cover the proposed payment to us.

7.3 No order will be deemed accepted by us until we have sent you an order confirmation email. Our order confirmation will confirm details of your order and confirm the beginning of the design process. If you do not receive an order confirmation within two (2) business days of submitting an order please email us at hello@bynoola.com,au.

7.4 While we do our best to confirm all orders we reserve the right to accept or reject all or any part of an order for any reason. If we are unable to accept your order the amounts paid by you in relation to the rejected order will be refunded and we will have no further liability to you in relation to the rejected order.

7.5 We reserve the right to retain copies of your product solely for the purposes of By Noola marketing including, but not limited to, sending to prospective customers and wholesalers and for general marketing and promotional use including social media & website marketing. By placing an order through By Noola, you automatically approve of the above terms.

8. Delivery
8.1 We aim to deliver the product to you at the place of delivery requested by you in your order confirmation.

 

8.2 We aim to deliver within the time indicated by us at the time of your order, however, we cannot promise an exact date. Our standard policy is to deliver your product within 6-8 weeks of your order, inclusive of design time, printing and shipping, which we accept but we cannot guarantee any firm delivery dates.

 

8.3 We will aim to let you know if we expect that we are unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

9. Returns Policy & Satisfaction Guarantee 

8.1 If your purchase isn't right due to our mistake (meaning a defect in the workmanship) please notify us at hello@bynoola.com within ten (10) business days of the order being delivered and we will replace the defective Products as soon as we are able, at no further cost to you. Please include your order confirmation number in that email message and, where possible, attach a digital photograph as evidence of the defect or damage. This policy is in addition to, and not in place of, your rights at law that cannot be lawfully excluded, including under the Consumer Guarantees Act 1993.

8.2 If you are not happy with your purchase due to your own error, such as a spelling mistake or if you have used images below our recommended resolution, we are happy to help you fix it and share in the cost of a replacement. In this case, we may ask that you return the item to us so that we can arrange for a single reprint at a discount of 50% of the recommended retail price at the time of purchase. 

8.3 We do not offer a colour correction service - we print images true to the supplied files, within the limitations of digital printing. We take any customer complaints about image quality seriously, but reserve the right to reject any complaints if upon our investigation shows print result matches the original images. Please ensure you read our Product Information carefully before placing your order. We clearly specify that is highly recommended you send us Professionally Photographed images only, and if you are sending us lower quality from a smart phone to accept fully that this quality will not be as clear. Please contact us at hello@bynoola.com.au if you have any queries at all regarding the print process or image quality prior to processing your order.

10. Cancellation

10.1 We may cancel an order if the product is not available for any reason. We will notify you if this is the case and return any payment that you have made.

We will refund any money received from you using the same method originally used by you to pay for the order.

10.2 If you wish to cancel your order please email hello@bynoola.com.au. A cancellation fee may apply depending on the time of cancellation. Once an order has been sent to print after final proof, it may not be cancelled and we will not refund you any payment made for the order.

11. Modifications

BY NOOLA may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
